Terms of Service

1. Scope and acceptance
These Terms govern your use of HostIQ AI ("Service"), a SaaS platform providing AI tools for short-term rental management. By using the Service you fully accept these Terms. If you do not accept them, do not use the Service.
2. Account
To register you must be at least 18 years old (or the age of majority in your country) and provide truthful information. You are responsible for keeping your credentials confidential and for all activity carried out from your account. Notify us immediately of any unauthorized use.
3. Subscription and activation
HostIQ AI is offered as a single paid plan, monthly or annual, with no free trial period. Access to the platform is activated immediately after payment. Subscriptions renew automatically at the end of each period unless cancelled from the Billing area before renewal. Cancellation stops future renewals; the period already paid remains active until its natural expiration. See section 5 for refund terms.
4. Prices, payments and taxes
Payments are processed by Stripe. Prices are shown in the currency displayed at checkout and are net of taxes. Applicable taxes (EU VAT, UK VAT, GST in Australia/Canada/India, US sales tax where due, etc.) are calculated automatically based on your jurisdiction and added to the total. EU/UK business customers outside Italy may apply the reverse charge by providing a valid VAT ID.
5. Right of withdrawal and refund guarantee
EU/EEA/UK consumers: under Directive 2011/83/EU (and the UK Consumer Rights Act 2015) you have the right to withdraw from the purchase within 14 days of subscribing, without giving any reason. For digital content (ebooks) made available immediately, by accepting the download you expressly waive the right of withdrawal pursuant to art. 16(m) of the Directive.
30-day commercial guarantee: in addition to statutory rights, HostIQ AI offers all customers, in any country, a "satisfied or refunded" guarantee within 30 days from the date of the first charge. If you are not satisfied, request a refund within this period by writing to info@host-iqai.com and you will be refunded with no further questions. Renewals following the first period are not covered by this guarantee. Local consumer laws granting you broader rights prevail.
6. Acceptable use
You agree not to use the Service for illegal activities, spam, infringement of third-party rights, reverse engineering, unauthorized scraping, or to train competing AI models. We may suspend or terminate the account in case of breach.
7. User content and license
You retain ownership of the content you upload (listings, messages, guest data). You grant us a limited, worldwide, non-exclusive, royalty-free license to process it solely to provide the Service. You are solely responsible for the lawfulness of uploaded content.
8. Intellectual property
The software, content, brand, ebooks and all materials of the Service are the property of HostIQ AI or its licensors. You are granted a personal, non-exclusive, non-transferable and revocable license limited to the duration of the subscription.
9. Disclaimer and limitation of liability
The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, we exclude any implied warranty of merchantability, fitness for a particular purpose and non-infringement. HostIQ AI is not liable for indirect, incidental, special or consequential damages, lost profits or lost data. Overall liability, for any cause, shall not exceed the amount paid by the user in the previous 12 months. Some jurisdictions do not allow the exclusion of certain warranties: in such case statutory minimum limits apply.
10. Indemnification
You agree to hold HostIQ AI harmless from any third-party claim arising from: (i) your breach of the Terms; (ii) content you upload; (iii) your non-compliant use of the Service.
11. Governing law and jurisdiction
These Terms are governed by Italian law, without prejudice to mandatory consumer protection rules of the user's country of residence. For consumers, the forum of place of residence or elected domicile applies (EU Reg. 1215/2012 for EU residents). For other (business) users, the Court of Milan, Italy, has exclusive jurisdiction. Nothing in this clause limits the mandatory rights of consumers.
12. Online dispute resolution (ODR)
Consumers residing in the EU may access the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.
13. Changes
We may update these Terms. Material changes will be notified to you by email or through the Service with at least 30 days' notice. Continued use of the Service after the effective date constitutes acceptance.
